The tariff classification of men’s garments from Norway.

Dear Mr. Ralston: In your letter dated February 26, 1999, you requested a tariff classification ruling on behalf of Reliable Racing Inc. The submitted samples will be returned as per your request. Five samples of men’s garments were provided for review. Style 01097 is a men’s underwear brief constructed of a knitted mesh polypropylene fabric. The brief features a two ply front panel of woven fabric over a knitted fabric and an elasticized waistband and leg openings. Style 12420 is a longer leg version of the brief, the submitted size large sample of this style measures approximately 16 inches from the waist to the leg openings. Style 01058 is a long leg underpants version of the brief featuring ribbed knit ankle cuffs. Style 01057 is a men’s long sleeve thermal undershirt constructed of a knitted mesh polypropylene fabric. The garment features a crew neck, and cuffs and edging at the neckline and bottom made of a ribbed knit material. Style 10730 is a zipped neck version of style 01057.  The applicable subheading for styles 01097, 12420 and 01058 will be 6107.12.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for Men's or boys' underpants, briefs, nightshirts, pajamas, bathrobes, dressing gowns and similar articles: underpants and briefs: of man-made fibers . . . men's. The duty rate will be 15.4 percent ad valorem. The applicable subheading for styles 01057 and 10730 will be 6109.90.1047, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of other textile materials: of man-made fibers . . . men's or boys': thermal undershirts. The duty rate will be 33 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
