Kansas City, MO 64141 RE: The tariff classification of a novelty drawstring purse from China. Dear Mr. Thayer: In your letter dated October 20, 1997, you requested a classification ruling for a novelty drawstring purse. The sample submitted, item 695VB01966, identified as a "Conversations Hearts Bear Fabric Candy Sack", is a novelty drawstring purse of a kind similar to those of HTS 4202. It is designed for reuse on a repetitive bases and for storage, protection, organization as well as some portability. The pouch is manufactured of an exterior surface of man-made textile materials with stuffed feet, legs and a head. The front of the pouch features a felt heart containing the words "Be Mine". The item measures approximately 6 1/2"(W) x 6 1/2"(H). Your sample is being returned as you requested. The applicable subheading for Item 695VB01966, the novelty drawstring purse of man-made materials, will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 19.3 percent ad valorem. The purse falls within textile category designation 670. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
