Two Harrison San Francisco, California 94105 RE: The tariff classification of girls' garments from Turkey and Greece. Dear Ms. Murphree: In your letter dated October 23, 1997, you requested a classification ruling on The Gap's Old Navy girls' line. Garment samples will be returned as per your request. Two sets and two separates were submitted for review. Style 463385 is a set consisting of a girls' crewneck short sleeve pullover and boxer bottom. The pullover is constructed of a solid color rib knit cotton fabric and features rib knit trim around the crewneck and sleeves and a hemmed bottom. The boxer short is constructed of a cotton jersey printed fabric and features an elasticized waist and hemmed bottom. Style 463386 is a set consisting of a girls' tank top and boxer bottom. The tank top is constructed of a solid color rib knit cotton fabric and features embroidered rib knit trim around the neckline, armholes, and shoulder straps and a hemmed bottom. The boxer bottom is identical to the style 463385 bottom. Style 463405 is a girls' undershirt constructed of a solid color rib knit cotton fabric with elasticized spaghetti straps. The undershirt features elasticized trim around the neckline and armholes and a hemmed bottom. Style 463406 is a girls' crop style undershirt constructed of a cotton pointelle fabric. The undershirt features embroidered rib knit trim around the neckline and armholes, and a fabric covered 3/4 inch elastic band bottom. The applicable subheading for the style 463385 pullover will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for Sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other . . . other: other: women's or girls'. The duty rate will be 19.4 percent ad valorem. The applicable subheading for the style 463386 tank top will be 6109.10.0065, HTS, which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . women's or girls': other: tank tops: girls'. The duty rate will be 19.6 percent ad valorem. The applicable subheading for the style 463385 and 463386 bottoms will be 6108.91.0040, HTS, which provides for Women's or girls' slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles, knitted or crocheted: other: girls'. The duty rate will be 8.8 percent ad valorem. The applicable subheading for styles 463405 and 463406 will be 6109.10.0037, Harmonized Tariff Schedule of the United States (HTS), which provides for T-shirts, singlets, tank tops and similar garments, knitted or crocheted: of cotton . . . Women's or girls': underwear. The duty rate will be 19.6 percent ad valorem. The style 463385 pullover and style 463386 tank top fall within textile category designation 339. The style 463385 and 463386 bottoms fall within textile category designation 350. Styles 463405 and 463406 fall within textile category designation 352. Based upon international textile trade agreements products of Turkey are subject to quota and the requirement of a visa. Currently products of Greece are not subject to quota or the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
