Hoem RE: The tariff classification of textile gloves from China. Dear Ms. Hoem: In your letter dated October 3, 1997, you requested a tariff classification ruling. The samples provided will be returned as requested. You submitted a style #VU9070, "Cirque" glove, and a #VU9080, "Cirque" mitt, for our examination. With the exception of the finger separations built into the #VU9070 glove, both items share almost identical construction characteristics. The outer shells are made from woven nylon with fabric-backed vinyl material inserted over the palm and finger areas. There are various finger and thumb tip vinyl reinforcements, extended gauntlets, fleeced interlock linings, and waterproof inserts with breathable backs. Each style includes a removable man-made fleece glove liner with outseam construction, which is attached to the outer glove by means of hook and loop strips. Other features include an adjustable textile strap and elastic at the wrist, an adjustable textile tether cord, and an adjustable textile over elastic cord tightener around the gauntlet opening. The essential character of the glove and mitt, which show a design for use in snowboarding, is imparted by the textile shell. The applicable subheading for the style #VU9070, "Cirque" glove, and a #VU9080, "Cirque" mitt, will be 6216.00.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts: Impregnated, coated or covered with plastic or rubber: Other gloves, mittens or mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens, and mitts... The rate of duty will be 4.1 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). -2- A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction.
