Dear Mr. Smithweiss: In your letter dated September 18, 1997, on behalf of your client Norma International, you requested a tariff classification ruling. You have submitted two samples. The first sample, identified as model #77131, is a glass water globe. It features a Christmas scene depicting characters of "Winnie the Pooh". Three characters are situated in front of a Christmas tree opening gifts. The base of the globe is molded and painted to resemble a stack of Christmas gifts with red and green ribbons. The second sample is identified as model #77126. It is a musical windup item that features the identical scene of the water globe mentioned above. The base is molded and painted to resemble Christmas gifts tied with red and green ribbons. The base also incorporates a windup musical mechanism which activates the melody of the Christmas carol "Deck the Halls". These samples are returned as requested. The applicable subheading for the glass water globe, model #77131, will be 9505.10.5020, Harmonized Tariff Schedule of the United States (HTS), which provides for festive...articles for Christmas festivities and parts and accessories thereof: other, other. The rate of duty will be free. The applicable subheading for the windup music box, model #77126, will be 9208.10.0000, HTS, which provides for music boxes...other musical instruments not falling within any other heading of this chapter...music boxes. The rate of duty will be 3.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
