Dear Ms. Bever: In your letter dated September 18, 1997, on behalf of The Dress Barn, Inc., you requested a tariff classification ruling. Style number 70013 is a woman's cardigan constructed from 68% polyester, 30% cotton, 2% spandex, openwork knit fabric(front and back panels) and 65% polyester, 35% cotton, ribbed fabric(sleeves). The outer surface measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a V-neckline; shoulder pads; short hemmed sleeves; a full front opening with 6 button loop closures; and a hemmed bottom. The neckline and placket are capped with the same fabric as the sleeves. Your sample will be returned as requested. The applicable subheading for the cardigan will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters...and similar articles, knitted: of man-made fibers: others. The duty rate will be 33.5% ad valorem. The cardigan falls within textile category designation 639. Based upon international textile trade agreements products of China and Hong Kong are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes.
