West 3185 H' Airway Avenue Costa Mesa, California 92626 RE: The tariff classification of a Girls' Blouse and Short Pant Set from Hong Kong Dear Ms. Thomas-Willett: In your letter dated September 12, 1997, you requested a tariff classification ruling. The sample provided, Style Number SU357/8, consists of a girls' blouse and short pant set in matching fabric. Using a dobby weave, flowers are embroidered onto the checkered background of the sleeveless blouse. The full frontal opening of the blouse has a four-button closure. A plain fabric is used for the piping at the v-neckline and armholes. The short pants, in material that matches the piping, feature a wide elastic waistband and ruffles at the end of each pant leg. The floral/checkered background of the ruffles match the pattern in the blouse. Both garments are made from 100% Cotton Chambray. You state the size range for the set will be Girls 2-9 years. The applicable subheading for the Girls' blouse will be 6206.30.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' blouses, shirts and shirt blouses: Of cotton: Other: Other: With two or more colors in the warp and/or the filling: Girls: Other. The rate of duty will be 16.1%. 2 The applicable subheading for the Girls' short pants will be 6204.62.4065, Harmonized Tariff Schedule of the United States HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of cotton: Other: Other: Other: Shorts: Girls': Other. The rate of duty will be 17.4%. The blouse falls within textile category designation 341. The short pants fall within textile category 348. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
