Drawer 30 Mobile, Alabama 36601 RE: The tariff classification of uniforms from Honduras. Dear Ms. Domning: In your letter dated May 16, 1997, on behalf of your client Selmer Aparel, L.L.C., you requested a classification ruling. The five submitted samples are uniforms stated to be used in the medical industry. The garments are marketed as wearing apparel to be worn by doctors, nurses, medical technicans, etc. in the medical field as advertised in the submitted catalog. Style 1140 is a men's uniform jacket with a zipper front, two inset breast pockets, two lower pockets, and a back belt sewn over pleats. You state that the garment consists of woven 65% polyester\35% cotton with a soil release finish. Style 8219 is a women's V-Neck tunic, with two front pockets, scissor holder in right pocket, and side vents. You state that the garment consists of 65% polyester/35% cotton woven poplin fabric. Style 8226 is a women's tunic, with a sculptured neckline, tailored back, sleeves shirred at shoulder, and a button front closure. You state that the garment consists of 65% polyester\35% cotton woven fabric. Style 8320 is a women's elastic pant featuring two-inch multi stitched covered elastic waistband, two side pockets, a sewn down front crease, and tapered leg. You state that the garment consists of 65% polyester\35%cotton woven poplin fabric, or twill of 75% polyester\25% cotton woven pincord. Style 8322 is a women's knit cuff pant which you state consists of 65% polyester/35% woven poplin fabric. The garment features a two-inch multi-stitched covered elastic waistband, two side pockets, and relaxed stockinette button cuffs. The applicable subheading for style 1140, the men's uniform jacket will be 6211.33.0058, Harmonized Tariff Schedule of the United States (HTS), which provides for Track suits, ski-suits and swimwear; other garments: Other garments, men's or boys': Of man-made fibers, Jackets and jacket-type garments excluded from heading 6201. The duty rate will be 16.7% ad valorem. The applicable subheading for style 8219, the women's V-Neck tunic and style 8226, the women's sculptured tunic will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Track suits, ski-suits and swimwear; other garments: Other garments, women's or girls': Of man-made fibers, Blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206. The duty will be 16.7% ad valorem. The applicable subheading for style 8320, women's elastic pant and style 8322 women's knit cuff pant will be 6204.63.3510, Harmonized Tariff Schedule of the United States (HTS), which provides for Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls breeches and shorts (other than swimwear): Trousers, bib and brace overalls, breeches and shorts: Of synthetic fibers: Other: Other: Other: Other, Trousers and breeches: Women's. The duty rate will be 29.9% ad valorem. Style 1140 falls within textile category designation 634. Styles 8219 and 8226 fall within textile category designation 641 and styles 8320 and 8322 fall within textile category 648. Based upon international textile trade agreements products of Hondras are "not" subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
