Box 986 Tampa, FL 33601 RE: The tariff classification of a "Breakwind" from China. Dear Mr. Laber: In your letter dated May 13, 1997, on behalf of The Breakwind Company, Nokomis, Florida you requested a tariff classification ruling. The submitted literature is for a "Breakwind" used outdoors to protect the user from wind. It is made of polyethylene mesh fabric. In open position it will be 30 inches long by 90 inches wide. Four sleeves are sewn at set intervals for the insertion of metal poles. When not in use it is stored in a plastic or nylon carry bag. The applicable subheading for the "Breakwind" will be 6307.90.9989, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles...Other. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
