Champlain, NY 1219 RE: The tariff classification of plastic bows and textile ribbon from China and Taiwan. Dear Mr. Cooper: In your letter dated November 11, 1996, on behalf of your client Tyesil Corp. Ltd., you requested a classification ruling. You have submitted two samples that are identified as (1) wire ribbon and (2) Christmas Bows. Sample (1) is a 2 inch wide ribbon made of woven fabric with wired edges. The ribbon is composed of 45 percent cotton, 25 percent nylon and 30 percent polyester. This ribbon is designed with metallic stars and wired edges that are covered with metallic strip. Sample (2) is an all purpose bow. The bow is made of plastic ribbon flocked on the one side with textile material. The red flocked bows are wrapped with a gold tinsel wire in order to attach this item to a gift package. The applicable subheading for the bow will be 3926.40.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics and articles of other materials of headings 3910 to 3914: Statuettes and other ornamental articles. The duty rate will be 5.3 percent ad valorem. The applicable subheading for the ribbon will be 5806.32.1090, HTS, which provides for narrow woven fabrics, other than goods of heading 5807; narrow woven fabrics consisting of warp without weft assembled by means of an adhesive (bolducs): other woven fabrics: of man-made fibers: ribbons: other. The duty rate will be 8.4 percent ad valorem. The ribbon falls within textile category designation 229. Based upon international textile trade agreements products of China and Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
