Coe Amway Corporation 7575 Fulton Street, East Ada, Michigan 49355-0001 RE: The tariff classification of a Lip Gloss and Eye Make-up sampler from China and/or Taiwan Dear Mr. Coe: In your letter dated August 9, 1996, you requested a tariff classification ruling. A sample of the Lip Gloss and Eye Make-up sampler was submitted with your inquiry and is being retained by this office. The booklet, measuring 2 inches by 2 inches, contains three samples of lip gloss and two samples of eye make-up. The lip gloss and eye make-up are placed on heavy stock paper and covered with clear plastic to prevent smearing. Based on your literature, this item will be used to solicit orders. The applicable subheading for the Lip Gloss and Eye Make-up sampler will be 9811.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for any sample (except samples covered by heading 9811.00.20 or 9811.00.40), valued not over $1. each, or marked, torn, perforated or otherwise treated so that it is unsuitable for sale or for use otherwise than as a sample, to be used in the United States only for soliciting orders for products of foreign countries. The rate of duty will be free. This product may be subject to the regulations of the Food and Drug Administration.
