Dear Ms. Puga: In your letter dated July 23, 1996, filed on behalf of Lady Ester Lingerie, you requested a tariff classification ruling. The submitted samples, style 21267, consist of a tank style camisole with garters and matching panties. The fronts of the garments are constructed of a lace like knitted nylon fabric and the backs are made of a sheer nylon fabric. The camisole features two inch wide shoulder straps, a five panel front, and a ruffle bottom with garters. The bikini style panties feature elasticized leg openings and waistband, and a separate sewn in crotch panel. The applicable tariff provision for the camisole will be 6109.90.1065, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for T-shirts, singlets, . . . and similar garments knitted or crocheted: of man-made fibers, women's or girls': tank tops and singlets, women's. The general rate of duty will be 33.6 percent ad valorem. The applicable tariff provision for the panties will be 6108.22.9020, HTSUSA, which provides for Women's or girls slips, petticoats, briefs, panties . . . , knitted or crocheted: briefs and panties: of man-made fibers. The general rate of duty will be 16.5 percent ad valorem. Textile merchandise which does not qualify as "originating" under the North American Free Trade Agreement (NAFTA), but which has been processed or further produced in Mexico and exported from that country, may be subject to quantitative export or import limitations based upon international trade agreements. The camisole falls within textile category 639 and the panties fall within textile category 652. Since quota and visa restrictions are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs Office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
