NY A83243 June 5, 1996 CLA-2-85:RR:NC:MA: 112 A83243 CATEGORY: Classification TARIFF NO.: 8544.20.0000; 8524.53.1040 Mr. Ray Portu Global Transportation Services, Inc. 9901 N.W. 106 St. Medley, FL 33178 RE: The tariff classification of a satellite dish installation kit from various Asian countries and India Dear Mr. Portu: In your letter dated May 8, 1996, on behalf of MEMCORP, Inc., you requested a tariff classification ruling. As indicated by the submitted sample, the installation kit, designated as DKIT944, contains various components needed to install an RCA DSS System. This system is a direct broadcast satellite dish which is capable of receiving digital data, and video/audio signals in the home through communication with high powered satellites. The DKIT944 kit consists of audio and video cables, telephone line cords, coaxial cables, installation hardware, and an instructional video tape. Since this is a kit, classification is goverened by the principles outlined in General Rule of Interpretation (GRI) 3(b). Therefore, the applicable tariff classification is determined by the component in the kit which imparts the essential character to the kit. The applicable subheading for the DKIT944 installation kit will be 8544.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for coaxial cable and other coaxial electric conductors. The rate of duty will be 5.3 percent ad valorem. In accordance with Chapter Note 6, Chapter 85, HTS, the instructional video tape must remain separately classified, regardless of GRI 3(b). Therefore, the applicable subheading for this video tape will be 8524.53.1040, HTS, which provides for video tape recordings of a width not exceeding 16mm, in casettes. The rate of duty will be 0.4 cent per linear meter. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
