Sullivan MSAS Customs Logistics Incorporated 248-06 Rockaway Boulevard Jamaica, New York 11422 RE: The tariff classification of a cardigan and a romper with a belt from Hong Kong Dear Mr. Sullivan: In your letter dated April 26, 1996, you requested a tariff classification ruling on behalf of Newport News, Incorporated. The submitted sample, Style # N9303, consists of a cardigan and a romper with a belt. Both garments are composed of identical, 65% polyester 35% cotton finely knit fabric. The cardigan features a full frontal opening with a five button closure; a deep v-neckline; long sleeves with attached cuffs; and a banded bottom. The romper features a tank style top portion with a rear neck opening having a one button and loop closure; an elasticized waistline; a bottom portion that is joined between the legs, has above the knee length, side seam hip pockets, and a hemmed bottom; and a self fabric belt backed with a nontextile material. Per your request, your sample is returned herewith. The applicable subheading for the cardigan will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted, of man-made fibers, other, other, other, other, other, women's. The rate of duty will be 33.8 percent ad valorem. The applicable subheading for the romper will be 6114.30.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted, of man-made fibers, other, sunsuits, washsuits, one-piece playsuits and similar apparel, women's or girls'. The rate of duty will be 15.9 percent ad valorem. The cardigan falls within textile category designation 639. The romper falls within textile category designation 237. Based upon international textile trade agreements, products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
