Interstate 95 Houlton, ME 04730 RE: The tariff classification of a drink product from Canada. Dear Mr. Gray: In your letter dated February 28, 1994, on behalf of Cape Breton Beverages, you requested a tariff classification ruling. A sample of the product label was included with your request. The subject merchandise is stated to contain filtered water with added sweetener and natural flavoring. The enclosed label indicates the merchandise also contains citric acid and various preservatives. The product is called "Proformance" and will be packaged for retail sale in 12 ounce containers. The applicable tariff provision for the drink product will be 2202.10.0060, Harmonized Tariff Schedule of the United States Annotated (HTSUSA), which provides for waters...containing added sugar or other sweetening matter or flavored...other. The general rate of duty will be 0.3 cents per liter. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
