Dear Ms. Furtado : In your letter dated February 22, 1994, on behalf of Cyrk, Inc., you requested a tariff classification ruling for utility tote bags and a man's shirt. The submitted samples, identified as items 1, 2, and 3, are as follows: Items 1 and 2 are small utility tote bags composed of a man-made material called Tyvek. Item 1 has a top zippered closure and measures approximately 8" x 6". Item 2 has an open top and measures approximately 7 3/4" x 7". They are carried by means of double textile or plastic carrying handles. The third item, identified as style MCS-224, is a man's shirt opened at the neck and buttons left over right. The shirt is made of 100 percent cotton denim fabric. Your samples are being returned as you requested. The applicable subheading for Items 1 and 2, the utility tote bags composed of Tyvek, will be 4202.92.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 20 percent. Items classifiable under 4202.92.3030 fall within textile category designation 670. Based upon international textile trade agreements, products of Hong Kong and Thailand are subject to visa requirements. Products of China and Taiwan are subject to visa requirements and quota restraints. The applicable subheading for Item 3, the man's shirt of 100 percent cotton denim fabric, will be 6205.20.2050, HTS, which provides for: men's or boys' shirts: of cotton: other: other: other: with two or more colors in the warp and/or the filling: other: men's. The duty rate will be 21 percent ad valorem. Item classifiable under 6205.20.2050 fall within textile category designation 340. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements. Products of China, Taiwan and Thailand are subject to visa requirements and quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
