Dear Ms. Diaz: In your letter dated February 17, 1994, you requested a tariff classification ruling. Style No. EF194-9400 is a man's vest constructed from 100 percent cotton, woven fabric. The garment features a full front opening with a zipper closure; a V-neckline; and an 80 percent cotton, 20 percent polyester, contrasting color binding around all the edges of the garment. Style No. EF194-8400 is the same garment as the aforementioned, but in boys' sizes S, M and L. Style No. GF294-3706 is a girl's sweater vest with a full front opening that fastens right-over-left and is secured by four buttons. The sample has a binding at the placket, the armholes, the neckline and the bottom edge. It is made of machine knit 55 percent ramie, 45 percent cotton yarn, and acrylic chenille yarn. There is no essential character. The fabric has less than nine stitches per two centimeters when measured in the horizontal direction. The garment will be imported in girls' sizes 4 to 6X and 7 to 14. Style No. GF294-3707 is a girl's full front opening cardigan that fastens right-over-left and is secured by five buttons. It has long sleeves and one-half inch edging at the neckline, the placket and the hem. The fabric has less than nine stitches per two centimeters when measured in the horizontal direction. The front panels are constructed from acrylic chenille yarn. The edging at the neckline, the placket and the hem is constructed from 55 percent ramie, 45 percent cotton yarn. The entire back and the sleeves are also constructed from 55 percent ramie, 45 percent cotton machine knit fabric. The garment will be imported in girls' sizes 4 to 6X and 7 to 14. The essential character is imparted by the 55 percent ramie, 45 percent cotton portion of the garment. The applicable subheading for Style Nos. EF194-9400 and EF194-8400 will be 6211.32.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for: track suits, ski-suits and swimwear; other garments: other garments, men's or boys': of cotton: vests. The duty rate will be 8.6 percent ad valorem. The applicable subheading for Style Nos. GF294-3706 and GF294-3707 will be 6110.90.0042, HTS, which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted; of other textile materials; sweaters: women's or girls': other: other: other. The duty rate will be 6 per cent ad valorem. Style Nos. EF194-9400 and EF194-8400 fall within textile category designation 359. Based upon international textile trade agreements, products of Bangladesh are subject to visa requirememts, but not quota restraints. Style Nos. GF294-3706 and GF294-3707 fall within textile category designation 845. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements, but not quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
