Society Karachi-29, Pakistan RE: The tariff classification of plastic flowerpots from Pakistan. Dear Mr. Dada Bhoy: In your letter dated January 30, 1994 you requested a tariff classification ruling. You are requesting classification of three flower pots for household use. You have provided pictures and specifications for all three. The square flower pot is approximately 12 inches square and weighs 7.5 kilograms. The round flower pot is approximately 10 inches in diameter and it weighs 2.5 kilograms. The hexagonal flower pot is approximately 8 inches across and weighs 1.75 kilograms. All three pots are made of unsaturated polyester resin, aluminum hydroxide powder, color pigment, styrene, wax, methyl ethyl ketone peroxide and cobalt. We assume that the aluminum hydroxide powder was synthetically produced and is not from a naturally occurring mineral. The applicable subheading for all three flower pots will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles and toilet articles of plastics, other, other. The duty rate will be 3.4 percent ad valorem. Articles classifiable under subheading 3924.90.5500, HTS, which are products of Pakistan are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations.
