Dear Mr. Li: In your letter received in this office on December 20, 1993, you requested a tariff classification ruling. Two samples have been submitted. Style #601200 is a man's shirt manufactured from a knit fabric composed of 100 percent cotton. The outer surface of the shirt is constructed with more than 10 stitches per linear centimeter in each direction. The garment features a partial frontal opening with two button closures, short sleeves with rib-knit sleeve ends and a spread collar. Also featured is a hemmed bottom, side slits and a tail. Style #601201 is a woman's pullover manufactured from a 100 percent cotton knit fabric. The outer surface of the garment is constructed with more than 9 stitches per 2 centimeters measured in the horizontal direction and less than 10 stitches per linear centimeter. The garment features a partial frontal opening with four button closures, short sleeves with rib-knit sleeve ends and a spread collar. Also featured is a hemmed bottom and side slits. The applicable subheading for the man's shirt will be 6105.10.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for men's...shirts, knitted...of cotton, men's. The rate of duty will be 45 percent ad valorem. The applicable subheading for the woman's pullover will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers,...knitted...of cotton, other...women's... The rate of duty will be 50 percent ad valorem. Style 601200 falls within textile category designation 338. Style 601201 falls within textile category designation 339. Based upon international textile trade agreements, products of Laos are not presently subject to visa requirements or quota restraints. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U. S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
