Ruling Text

NY 892009 November 4, 1993 MAR-2-49:S:N8:234 892009 CATEGORY: Marking TARIFF NO.: 4908.10.0000 Mr. Chris Dodd Stained Glass Systems Limited 5 Hollytree Parade Sidcup, Kent DA14 6JR, England RE: Declaration of Country of Origin Dear Mr. Dodd We have your letter dated Nov. 1, 1993, sent by facsimile transmission (Fax) from your number 081 302 2502, in which you inquire about country of origin declaration for merchandise, classifiable in HTS subheading number 4908.10.0000, originating in Italy. Documents submitted to U.S. Customs for this merchandise entering the United States, originating in Italy, must declare Italy as the country of origin. Further, the merchandise itself is required to be marked to indicate its country of origin, Italy, "in a conspicuous place as legibly, indelibly, and permanently as the nature of the article...will permit in such a manner as to indicate to an ultimate purchaser in the United States the English name of the country of origin of the article." 19 U.S. C. 1304. ("EEC" has been determined not to be acceptable as such "English name of the country of origin", for the purpose of this statute.) We understand the concerns you expressed, but we are unable to relieve imported merchandise from the explicit requirements of our law on the subject. Sincerely, Jean F. Maguire Area Director New York Seaport
