Your letter states that these plates are made of specially tempered glass. Samples were submitted with your ruling request. In order to verify that this glassware is specially tempered, we must send the samples to our Customs Laboratory for analysis. At the present time, the methods used to test specially tempered glassware are under review by the Laboratory Services Division of U.S. Customs Service Headquarters. A notice has been published in the Federal Register soliciting comments on the proper testing procedures for specially tempered glassware. When all these comments are received and analyzed, Customs Headquarters will issue guidelines on the proper tests to be performed. Until this directive is issued, our Customs Laboratory will not be analyzing any samples of glassware claimed to be specially tempered. For the reasons explained above, we are unable to issue a ruling on this merchandise at the present time. We suggest that you resubmit your ruling request at a future date. Sincerely, Jean F. Maguire Area Director New York Seaport
