Wiskin Freeman, Wasserman and Schneider 90 John St. New York, NY 10038 RE: The country-of-origin marking of pens from Spain and Japan Dear Mr. Wiskin: In your letter dated October 1, 1990, on behalf of Faber Castell Corporation you requested a ruling on country of origin marking. The merchandise consists of three types of importations: the "B-55", the "Pony", and the "Compo". The "B-55" pen consists of a plastic and stainless steel barrel. The word "Spain" is etched on the bottom of the stainless steel portion of the barrel, in line with the trade name of the pen. The "Pony" pen is plastic, with the word "Spain" indelibly silk-screened on the side of the barrel where the clip cannot conceal it. The "Compo" is a set consisting of a ball-point pen, mechanical pencil and marker. The three writing implements are contained in, and snap into, a specially designed plastic holder. Each of the "Compo" implements is blind-stamped with the word "Japan"; however, in addition, the country of origin is clearly marked on the bottom of the plastic holder. In each instance, the marking is sufficient to satisfy the requirements of 19 U.S.C. 1304. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
