Wiskin Freeman, Wasserman & Schneider 90 John Street New York, NY 10038 RE: The marking of pencils from Japan. Dear Mr. Wiskin: In your letter dated June 27, 1990, on behalf of Faber- Castell Corporation, you requested a marking ruling. The merchandise will be mechanical pencils. You intend to mark them on the stainless steel clip. The word "Japan" will be etched on the bottom of the width of the clip, below the brand name and the name of the importer. This marking is sufficient to satisfy the requirements of 19 USC 1304. The sample you submitted showed that the marking will be legible and in a conspicuous place. The same type of marking would be acceptable on pens. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
