Wiskin Freeman, Wasserman & Schneider 90 John Street New York, NY 10038 RE: The marking of pens from Japan. Dear Mr. Wiskin: In your letter dated June 27, 1990, on behalf of Faber- Castell Corporation, you requested a marking ruling. The merchandise will be mechanical pencils. You intend to mark them on the stainless steel clip. The word "Japan" will be etched on the bottom of the width of the clip, below the brand name and the name of the importer. This marking is sufficient to satisfy the requirements of 19 USC 1304. Your submission did not contain a finished sample for examination. While the marking will be in a conspicuous place, care must be taken that it prove sufficiently legible to be read by the ultimate purchaser without undue effort. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
