Box 19169 Charlotte, NC 28217-9169 RE: The tariff classification of a woman's halter top from Hong Kong Dear Ms. Helmly: In your letter dated November 30, 1995, you requested a classification ruling on behalf of Tweeds, Inc. The sample submitted with your request will be returned to you under separate cover. Style 14391 is a halter top constructed from 100 percent cotton woven fabric. The garment features a v-neckline and front panels that extend into 2 1/2 inch wide shoulder straps that tie around the neck. The banded bottom extends into 1 1/2 inch wide straps that tie in the back. The garment does not provide back or shoulder coverage and does not reach the waist. The applicable subheading for the garment will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women's or girls': other. The duty rate will be 8.6 percent ad valorem. Style 14391 falls within textile category designation 359. Based upon international textile trade agreements products of Hong Kong are subject to a visa requirement and quota restraints. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
