Castrucci Follick & Bessich, P.C. 225 Broadway New York, NY 10007 RE: The tariff classification of a Brush/Comb Combo Set from China. Dear Ms. Castrucci: In your letter dated December 1, 1995, on behalf of Conair Corporation, you requested a tariff classification ruling. The submitted sample, item # 81764, is a four piece hair styling kit containing one hairbrush, two combs and one hair pick, all packed in a vinyl bag. The brush, combs and pick are all of plastic. Your sample will be returned as requested. The hair styling kit is a set which is classified under the General Rules of Interpretation (G.R.I.) 3. (c) which states: When goods cannot be classified by reference to 3(a) or 3(b) they shall be classified under the heading which occurs last in numerical order among those which equally merit consideration. These items are the two combs and one plastic pick, all classifiable in subheading 9615.11.3000, HTS, which provides for Combs, ...: Of hard rubber or plastics: Combs: ... Valued over $4.50 per gross: ... Other. The rate of duty will be 28.8 cents gross plus 4.6% ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations 19 (C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
