NY 816973 December 28, 1995 CLA-2-62:R:N5:360 816973 CATEGORY: Classification TARIFF NO.: 6208.21.0020 Ms. Lisa Bertha Tweeds, Inc. 115 River Road Edgewater, NJ 07020 RE: The tariff classification of a women's intimate apparel garment from Hong Kong Dear Ms. Bertha: In your letter dated November 1, 1995 and follow-up submisison of November 22, 1995, you requested a classification ruling. The sample submitted with your request will be returned to you under separate cover. Style 04181 is a women's intimate apparel garment constructed from 100 percent cotton woven fabric. The garment extends to the mid-calf and features non-adjustable shoulder straps and a decorative fagotting stitch around the front and back necklines, the straps and the bottom hem. The size range for the garment is XS through XL. In your letter you have indicated that this garment will be merchandised in your catalogue along with other intimate apparel such as a silk chemise, a full length slip, a cotton/lycra camisole and bodysuit. These items will be sold separately.You have also provided specifications and fabric weight information. Based on the information submitted, we agree that this garment will be principally used as a sleep garment. The applicable subheading for style 04181 will be 6208.21.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for women's or girls' singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: nightdresses and pajamas: of cotton: other: women's. The duty rate for 1996 will be 9.4 percent ad valorem. Style 04181 falls within textile category designation 351. Based upon international textile trade agreements products of Hong Kong are subject to a visa requirement and quota restraints. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
