Dear Mr. O'Neill: In your letter dated November 3, 1995, on behalf of your client Sterling, Inc., you requested a tariff classification ruling. The submitted sample is identified as item no. 15027, a carrot tree. The trunk portion of this carrot tree is composed of three styrofoam carrots wrapped in orange paper and glued together. A paper string is wrapped around the carrots and tied in a bow. Each carrot has green paper sprigs in the top. The branches are made of wire that have been covered with green styrofoam and there are little plastic carrots with green paper tops on a number of the branches. This carrot tree stands in a round white wood box with a white picket wood fence around the outside. Inside the wood box are short strips of green paper to give the appearance of grass. The applicable subheading for the carrot tree, will be 6702.90.6500, Harmonized Tariff Schedule of the United States (HTS), which provides for artificial flowers, foliage and fruit and parts thereof; articles made of artificial flowers, foliage or fruit: of other materials, other, other. The rate of duty will be 17 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
