Dear Mr. Plenby: In your letter dated August 22, 1995 you requested a tariff classification ruling. You submitted to samples. Style number A1130 is a woman's hooded vest constructed from 60% cotton, 40% polyester, finely knit fabric. The vest features a hood; oversized armholes; a full frontal opening with six button closures; two slanted, front, patch pockets below the waist; and a drawstring bottom. Style number A1136 is a woman's short sleeved cardigan constructed from 60% cotton, 40% polyester, finely knit fabric. The garment features shoulder pads; short sleeves; a full front opening with a tie closure that fastens right over left; and two sideseam pockets in the waist area. The applicable subheading for style A1130 will be 6110.20.2035, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters....(vests)...and similar articles, knitted: of cotton: other: vests, other than sweater vests. The duty rate will be 20.3% ad valorem. The applicable HTS subheading for style A1136 will be 6110.20.2075, which provides for women's sweaters, pullovers and similar articles, knitted: of cotton: other. The duty rate will be 20.3% ad valorem. Style A1130 falls within textile category designation 359. Style A1136 falls in category 339. Based upon international textile trade agreements products of Taiwan are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
