Dear Mr. Maher: In your letter dated August 31, 1995, on behalf of Children's Place, you requested a classification ruling. As requested, the sample will be returned to you. The submitted sample, style 8478508-511, is a pair of cotton woven boys' underwear boxer shorts. The item features an exposed elasticized waistband, fly front and hemmed leg openings. The applicable subheading for style 8478508-511, will be 6207.11.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for men's or boys' singlet and other undershirts, underpants, briefs, nightshirts, pajamas, bath-robes, dressing gowns and similar articles: underpants and briefs: of cotton. The duty rate will be 6.5 percent ad valorem. Style 8478508-511, falls within textile category designation 352. Based upon international textile trade agreements products of Hong Kong are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes.
