Dear Mr. Plenby: In your letter dated July 25, 1995 you requested a tariff classification ruling. You submitted two styles with your request, which were destroyed during laboratory analysis. Style TK5808 is a woman's knit pullover which has more than nine stitches per two centimeters, measured in the horizontal direction. The pullover features a rib knit turtleneck, short sleeves with rib knit cuffs and a rib knit waistband. Style TK5828 is a woman's knit pullover which has more than nine stitches per two centimeters, measured in the horizontal direction. The pullover features a round neck, long sleeves with a tubular edge, and a tubular finish at the bottom of the garment. Both styles have a fiber content of 30% rayon, 28% acrylic, 24% wool and 18% metallic. Both styles are made in Hong Kong. The applicable subheading for Styles TK5808 and TK5828 will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, knitted, of man-made fibers, other, other, other, other, other, women's. The duty rate will be 34% ad valorem. Styles TK5808 and TK5828 fall within textile category designation 639. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
