Dear Ms. Kelly-Kobayashi: In your letter dated May 23, 1995, on behalf of Rafaella Sportswear, Inc., you requested a tariff classification ruling. Style number RW0225 is a woman's pullover made from 100% polyester, polar fleece, knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters horizontally. The pullover features a drawstring hood; long, hemmed sleeves; a partial opening with a zipper closure; 2 side slits; and a hemmed bottom. Style number RS3253 is a woman's jacket constructed from 100% silk, woven fabric. The garment features a notched-lapel collar; attached shoulder pads; long sleeves with one button cuffs; a full front opening with 3 button closures; a drawstring waist; a one button, left chest pocket; 2 one button, flap pockets below the waist; 2 side slits; and a hemmed bottom. Your samples are being returned as requested. The applicable subheading for the pullover will be 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS), which provides for women's pullovers, knitted: of man-made fibers: other. The duty rate will be 34% ad valorem. The applicable HTS subheading for the jacket will be 6211.49.1080, which provides for women's other garments: of other textile materials: containing 70% or more by weight of silk or silk waste: jackets and jacket-type garments excluded from headings 6202. The rate of duty will be 7.1% ad valorem. Style RW0225 falls within textile category designation 639. Style RS3253 falls in category 735. Based upon international textile trade agreements products of Korea and China are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
