Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a singing Santa from China. Dear Ms Aldinger: In your letter dated May 5, 1995, you requested a tariff classification ruling. You state that you wish a ruling on an assortment you call a "Christmas Singing Santa/Barking Dog Assortment". It is your item number #96354. You state that the assortment consists of two separate items. One is a singing Santa. The other is a barking dog. They are stuffed plush items that when squeezed sing/bark Christmas tunes. You have submitted a sample of only the singing Santa. Without a sample we can not rule on the classification of the barking dog. The applicable subheading for the singing Santa will be 9505.10.5020,Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof, other, other. This subheading is free of duty. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
