Box 711 Ligonier, PA 15658 RE: The tariff classification of a plastic base from China. Dear Ms. Murphy: In your letter dated March 30, 1995, you requested a tariff classification ruling. Sample is being returned as requested. The sample submitted is a plastic base for a glass Christmas tree. The base is round in shape and is constructed of gold or brass colored plastic. On top of the base stand three battery operated miniature light bulbs which illuminate the interior of the glass Christmas tree. An on-off switch is located on the bottom. The plastic base serves both as a support base and as a housing to contain the batteries and light bulbs, while concealing these items from view. The applicable subheading for the above plastic base will be 9405.40.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings not of base metal. The rate of duty will be 3.9 percent ad valorem. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
