NY 808400 April 25, 1995 MAR-2-90:S:N:N3:119 808400 CATEGORY: Marking Ms. Lisa Castillo FRACHT FWO INC. 147-39 175th Street Jamaica, NY 11434 RE: The country of origin marking of an Adec converter from the United Kingdom Dear Ms. Castillo : In your letter dated March 23, 1995, you requested a marking ruling on behalf of Sultan Dental Products, Englewood, NJ 07631. The article to be imported is a metal converter for a dental syringe handpiece to accept certain disposable syringe tips. The converter is cylindrical in shape with a flat groove on either side. It measures 5/8 of an inch in height and 9/16 of an inch in outer diameter. The Customs Regulations at 134.11 require that every article of foreign origin (or its container) imported into the U.S. shall be marked in a conspicuous place as legibly, indelibly, and permanently as the nature of the article (or container) will permit, in such manner as to indicate to an ultimate purchaser in the U.S. the English name of the country of origin of the article. In addition, Section 134.43 of the Customs Regulations requires that certain articles such as dental instruments and parts thereof be marked by die stamping, engraving, etc. The marking you suggested, die stamping of the country of origin on the side of the converter, would satisfy the regulations if it is conspicuous and legible. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
