Box 523730 Miami, FL. 33152-3730 RE: The tariff classification of men's knit garments from Peru. Dear Mr. Ruiz: In your letter dated March 1, 1995 you requested a tariff classification ruling on behalf of Cypress Apparel Group. Style number 75002T is a man's pullover garment constructed from 100 percent cotton, jersey knit fabric containing more than 9 stitches per two centimeters counted in the horizontal direction. The garment features a rib knit crew neckline; long sleeves with rib knit cuffs; and a hemmed bottom with side slits. There is a woven triangular overlay sewn to the center front neckline and a triangular sweat patch sewn to the inner rear neckline. A woven "Tommy Hilfiger" label, which measures two inches long by seven-eights of an inch wide, is sewn to the center rear panel below the nape of the neck. This label is affixed to a strip of knit fabric, measuring four inches long by seven-eights of an inch wide, which is cross stitched at both ends. Style number 75012T is a man's pullover garment constructed from 100 percent cotton, jersey knit fabric containing more than 9 stitches per two centimeters counted in the horizontal direction. The garment features a rib knit crew neckline; short, hemmed sleeves; and a hemmed bottom with side slits. There is a woven triangular insert at the center front neckline and a triangular sweat patch sewn to the inner rear neckline. A hanger loop with a woven "Tommy Hilfiger" label measures four inches long by seven-eights of an inch wide and is cross stitched to the center rear panel below the nape of the neck. The applicable subheading for Style numbers 75002T and 75012T will be 6110.20.2065, Harmonized Tariff Schedule of the United States (HTS), which provides for: pullovers and similar articles, knitted or crocheted: of cotton: other: other: other: men's. The duty rate will be 20.3 percent ad valorem. Style numbers 75002T and 75012T fall within textile category designation 338. Based upon international textile trade agreements, products of Peru are subject to visa requirements. The designated textile and apparel category may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Since part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes, to obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report On Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported.
