Box 4500 Westborough, MA 01581-4500 RE: The tariff classification of Bupivacaine Hydrochloride (CAS Reg. No. 14252-80-3), in bulk form, from Sweden Dear Mr. Hayward: In your letter dated September 30, 1994, you requested a tariff classification ruling. The subject product, Bupivacaine Hydrochloride, chemically designated as 1-Butyl-N-(2,6-dimethylphenyl)-2-piperidinecarboxamide-monohydrochloride, monohydrate, is a local anesthetic. You state that the product will be imported in bulk form. The applicable subheading for the subject product will be 2933.39.4200, Harmonized Tariff Schedule of the United States (HTS), which provides for: "Heteroyclic compounds with nitrogen hetero-atom(s) only; nucleic acids and their salts: Compounds containing an unfused pyridine ring (whether or not hydrogenated) in the structure: Other: Other: Drugs: Other." The rate of duty will be 8 percent ad valorem. This merchandise may be subject to the regulations of the Food and Drug Administration. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
