Dear Mr. Pipitone: In your letter dated September 26, 1994, on behalf of Carnegie Fabrics, Rockville Center, New York, you requested a tariff classification ruling. Submitted are five sample books, identified as style number "Living". The sample books are made up of fabric swatches that are rectangular shaped with pinked edges. The swatches are bound in binders. Three of the books measure approximately 10 1/2" x 12" and two books measure approximately 25" x 25". The swatches are used for soliciting orders for products of foreign countries. The samples are being returned as requested. The applicable subheading for the sample books will be 9811.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for any sample (except samples covered by heading 9811.00.20 or 9811.00.40), valued not over $1 each, or marked, torn, perforated or otherwise treated so that it is unsuitable for sale or for use otherwise than a sample, to be used in the United States only for soliciting orders for products of foreign countries. The rate of duty will be free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs officer handling the transaction. Sincerely, Jean F.
