HQ 735412 January 21, 1994 MAR-2-05 CO:R:C:V 735412 RC CATEGORY: MARKING District Director of Customs Tampa, Florida 33605 RE: Internal Advice Request from Florida Holiday Vacations Dear Sir: On October 28, 1993, this office received your memorandum discussing a request for internal advice made by Mr. Geff Smith on behalf of Florida Holiday Vacations. Mr. Smith requests a waiver of the special marking requirements for watches. Under Chapter 91, Harmonized Tariff Schedule of the United States (HTSUS), Note 4, any watch movement, or case provided for in the subpart, whether imported separately or attached to any article provided for in the subpart, shall not be permitted to be entered unless conspicuously and indelibly marked by cutting, die-sinking, engraving, or stamping or mold- marking (either indented or raised), as specified in the provisions of this note. The Customs Service has no authority to grant exceptions to the special marking requirements for watches. See HQ 726711, October 22, 1984. (copy attached). Sincerely, Thomas L.
