SUPPLEMENTARY INFORMATION: Reopening the Record In March 2003, the Commission made a final affirmative determination in the referenced investigation. The determination was appealed to the U.S. Court of International Trade (CIT), which affirmed the Commission upon remand, and was then appealed to the U.S. Court of Appeals for the Federal Circuit, which vacated and remanded the Commission's determination. Bratsk Aluminum Smelter v. United States , 444 F.3d 1369 (Fed. Cir. 2006).
