Florida Keys National Marine Sanctuary Final Regulations

Abstract

Pursuant to the Florida Keys National Marine Sanctuary and Protection Act and the National Marine Sanctuaries Act, NOAA has developed the comprehensive final management plan for the Florida Keys National Marine Sanctuary (FKNMS or the Sanctuary). NOAA hereby issues final regulations to implement that plan and govern the conduct of activities within the Sanctuary. This document also summarizes the Final Management Plan--Environmental Impact Statement (FMP/EIS) for the Sanctuary. The FMP/EIS details the goals and objectives, management responsibilities, research activities, educational and outreach programs, and interpretive enforcement activities for the Sanctuary. The intended effect of the final regulations, and FMP/EIS is to protect and manage the conservation, recreational, ecological, historical, research, educational, and aesthetic qualities of the Sanctuary consistent with the Florida Keys National Marine Sanctuary and Protection Act and the National Marine Sanctuaries Act.

Dates
Congress and the Governor of the State of Florida have forty-five days of continuous session of Congress beginning on the day on which this document is published to review the regulations before they take effect. After forty-five days, the regulations automatically become final and take effect, unless the Governor of the State of Florida certifies within the forty-five-day period to the Secretary of Commerce that a regulation or regulations is unacceptable. In such case, the regulation (or regulations) cannot take effect in the area of the Sanctuary lying within the seaward boundary of the State of Florida. In no event will Sec. 922.164(d) become effective in State waters before July 1, 1997. A document announcing the effective dates will be published in the Federal Register.
