Department of Justice Drug Enforcement Administration On August 16, 2024, the Drug Enforcement Administration (DEA or Government) issued an Order to Show Cause (OSC) to David S. Pecora, P.A., of Bemidji, Minnesota (Applicant). Request for Final Agency Action (RFAA), Exhibit (RFAAX) 1, at 1, 15. The OSC proposed the denial of Applicant's application for DEA registration, Control Number W23054133M, alleging that he materially falsified multiple applications for registration and that his registration would be inconsistent with the public interest. Id. at 1 (citing 21 U.S.C. 823(g)(1) , 824(a)(1) ). [ 1 ] On September 30, 2024, the Government submitted a RFAA to the Administrator requesting that the Agency issue a default final order denying Applicant's application. RFAA, at 1, 3-4. After carefully reviewing the entire record and conducting the analysis as set forth in detail below, the Agency grants the Government's request for final agency action and denies Applicant's application. As a preliminary matter, this Decision addresses whether or not Applicant is in default and finds that he is. Thereafter, this Decision makes specific factual findings on the alleged violations as set forth in the OSC. Specifically, this Decision considers whether Applicant submitted a materially false application and finds that he did.
