Department of Transportation Federal Railroad Administration [Docket Number FRA-2022-0030] Under part 211 of title 49 Code of Federal Regulations (CFR), this document provides the public notice that on March 31, 2022, Arcade and Attica Railroad Corporation (ARA) petitioned the Federal Railroad Administration (FRA) for a waiver of compliance from certain provisions of the Federal railroad safety regulations contained at 49 CFR part 223 , Safety Glazing Standards—Locomotives, Passenger Cars and Cabooses. FRA assigned the petition Docket Number FRA-2022-0030. Specifically, ARA requests a waiver from the glazing regulations in 49 CFR part 223 for one locomotive, #113. ARA states that the locomotive is equipped with one-quarter-inch safety glass, consisting of two glass plates with a laminating material. In support of its request, ARA states that it is a short line historic railroad and freight carrier serving two customers on 15 miles of track at slow speeds, installing custom glazing would be cost prohibitive, and it reports no vandalism or window breakage issues in the past.
