Dear Mr. Chu: In your electronic ruling request dated October 3, 2006, you requested a tariff classification ruling on behalf of Airsoft Solutions, Monterey Park, CA. The merchandise is described as a biodegradable BB for use with airsoft guns. The BB is composed of powder encased in a hard shell that dissolves when it comes in contact with moisture. Powder or liquid-filled projectiles, containing no explosives, pyrotechnics or propellants, delivered by airsoft guns that use compressed air or CO2 as the delivery propellant are classifiable in subheading 9306.30.4060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Bombs, grenades, torpedoes, mines, missiles and similar munitions of war and parts thereof; cartridges and other ammunition and projectiles and parts thereof, including shot and cartridge wads: Other cartridges and parts thereof: cartridges and empty cartridge shells, Other.” The rate of duty is free. Duty rates are provided for your convenience and are subject to change.
