TARIFF NO.: 8708.39 Ms. Michele Mitchell Customs Coordinator Ambrake Corporation 300 Ring Road Elizabethtown, KY 42701 RE: Status under the North American Free Trade Agreement (NAFTA), of automotive brake parts from the U.S.; Article 509 Dear Ms. Mitchell: In your letter dated 09-13-06 you requested a ruling on the status of brake parts from the U.S. under the NAFTA. You state that your company manufactures complete brake assemblies for export to Canada or Mexico. You request a ruling as to whether or not, (under particular manufacturing processes that you describe) they are originating in the United States for purposes of NAFTA. Article 509, paragraph 4 of the NAFTA agreement states: 4. Subject to paragraph 6, each Party shall apply an advance ruling to importations into its territory of the good for which the ruling was requested, beginning on the date of its issuance or such later date as may be specified in the ruling. We are unable to answer your request since the goods are being imported into the territories of Canada or Mexico. We suggest that you address your requests to the appropriate agencies in these countries.
