Dear Mr. Nuristani: In your letter dated January 4, 2005, you requested a tariff classification ruling. The merchandise to be imported is as follows: Item number 47418 is a Steel Service Cart with a two-drawer tool chest. The item has four swivel casters with locking brakes. The dimensions are 30”L x 16”W x 27½”H. The drawers are 22¼” wide and 14” long. The top drawer is 2½” deep and the bottom drawer is 3½” deep. The article has a tough powder coat finish and weighs 75 lbs. Item number 5107 is a Steel Service Cart with two swivel casters and two rigid directional wheels. The dimensions are 16”W x 30”L x 27½”H. It has two 3½” deep trays, a tubular steel handle, and a tough enamel finish. The item weighs 29 lbs. and has a load capacity of 220 lbs. The applicable subheading for the steel service carts will be 9403.20.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other metal furniture, Other: Other.” The rate of duty will be Free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
