NY R00983 October 29, 2004 CLA-2-85:RR:NC:MM:109 R00983 CATEGORY: Classification TARIFF NO.: 8505.90.8000 Mr. Gary Gessler Global Team Leader Sandler & Travis Trade Advisory Services, Inc. 36555 Corporate Drive Suite 400 Farmington Hills, MI 48331 RE: The tariff classification of a solenoid “Exhaust Gas Control (EGR) valve subassembly” (Part Number 5.36212.08.0) from an unspecified country Dear Mr. Gessler: In your letter dated October 21, 2004, you requested a tariff classification ruling on behalf of Pierburg Inc., Fountain Inn, South Carolina. The merchandise is described in your letter as a solenoid (Part Number 5.36212.08.0). The solenoid, which is an actuating element, is incorporated into an exhaust gas control (EGR) valve for use in an automobile. The solenoid is an electrical subassembly made of steel, copper and plastic. When voltage is applied to the coil of the solenoid, it creates a magnetic field, which applies a magnetic force on the core. The core acts as an actuator within the EGR valve when the magnetic force pushes the core out of the body, opening or closing the valve as required. Once the voltage is removed an internal spring retracts the core back into the body of the solenoid. The applicable subheading for the solenoid “Exhaust Gas Control (EGR) valve subassembly” (Part Number 5.36212.08.0) will be 8505.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Electromagnets;…; parts thereof: Other, including parts: Other.” The rate of duty will be 1.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
