La Cienega Blvd. Los Angeles, CA 90045 RE: The tariff classification of a costume from China and Vietnam. Dear Mr. Gomez: In your letter dated September 25, 2022, you requested a tariff classification ruling on behalf of your client, California Costume, Inc. You submitted an adult size costume identified as Fantasy Hospital Gown, item number 5023-043, depicting a hospital patient costume. The flimsy man-made knitted textile gown with printed hearts features large visible loose overlock stitching around the neckline, raw unfinished edges on the sleeves, hem bottom and back opening. The back opening is closed with three sets of flimsy string ties. The gown is constructed with large loose straight stitching. The applicable subheading for the Fantasy Hospital Gown, item number 5023-043 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
