La Cienega Blvd. Los Angeles, CA 90045 RE: The tariff classification of a costume from Hong Kong, China and Vietnam. Dear Mr. Gomez: In your letter dated August 24, 2021, you requested a tariff classification ruling on behalf of your client, California Costume, Inc. You have submitted a costume identified as the child size, Crazy Eyed Clown, item numbers 3121-192 and SP-3121-192, which consists of a jumpsuit, mask and a separate collar. GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” The flimsy man-made textile jumpsuit imparts the essential character and is constructed with large loose straight stitching. The neckline features large, visible, loose overlock stitching and the large back opening has raw unfinished edges and is closed with small hook and loop tabs. The long sleeves and bottom leg openings have jagged cut, raw edges with narrow exposed elastic. The applicable subheading for the Crazy Eyed Clown Costume, Item numbers 3121-192 and SP-3121-192 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
