N316963 February 11, 2021 CLA-2-29:OT:RR:NC:N3:138 CATEGORY: Classification TARIFF NO.: 2907.29.9000 Ms. Sheila Heerdt Ren Pharm International, Ltd. 350 Jericho Turnpike, Suite 204 Jericho, NY 11753 RE: The tariff classification of Tapinarof (CAS No. 79338-84-4) in bulk powder form, from Spain Dear Ms. Heerdt: In your letter dated January 14, 2021, you requested a tariff classification ruling. Tapinarof (also known as Benvitimod) is an aryl hydrocarbon receptor agonist. Currently, Tapinarof is undergoing clinical studies for the treatment of plaque psoriasis and atopic dermatitis. The applicable subheading for the Tapinarof in bulk powder form will be 2907.29.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Phenols; phenol-alcohols: Polyphenols; phenol-alcohols: Other: Other.” The rate of duty will be 5.5 percent ad valorem. Currently, Tapinarof is not listed in the Pharmaceutical Appendix to the Tariff Schedule. Duty rates are provided for your convenience and are subject to change.
